I’ve learned that many police officers will make concessions when cross-examined on the stand and confronted with the proper way of making a stop or detention, conducting a search of my client’s home or vehicle, or administering field sobriety tests, breath tests or blood tests.

When it comes to a DWI charge many people prematurely plead guilty based on a failed breath test. This is often a grave mistake. There is often a chance that your breath test results can be suppressed. The breath test machine (intoxilyzer) is not a perfect machine. There can be many sources of error in the breath test analysis. The intoxilyzer does not measure a person’s breath test temperature. The machine is programmed to assume a certain value for the breath test temperature. If your breath temperature is different from what the computer assumes is your breath temperature, even by one degree, then the results can be incorrect. The intoxilyzer may also mistakenly measure residual mouth alcohol in your mouth tissues instead of the deep lung air. This can also result in a falsely high breath test score. The biggest problem with the intoxilyzer is that it measures your blood alcohol content when you blow in the machine. Texas law mandates that the state prove what your blood alcohol content was at the time you were driving. Your breath test score an hour after the stop is not what your blood alcohol level might have been when the officer stopped you. Please read the “FAQ” section of my website to learn more about alcohol absorption between the time you are stopped and the time when you take the breath test. A person’s blood alcohol level can actually rise by as much as .08 an hour after they stop drinking.
